Excellent News! You probably saw our totally amazing new promotional buttons on the home page! All orders placed in the next few weeks will receive one of our amazing new buttons until we run out – we’ve got hundreds, but don’t hesitate! We get the feeling they will run out fast.
Promotion Details:
We decided to sponsor a contest! All customers are invited to compete! This is how the promotion will go: You place an order with Empire, we ship your order with one of our awesome promotional buttons, you take a picture of yourself, or your posse, (see details below), you send the picture to support@empireboardgames.com. You’re entered into our contest! It’s that simple!
Conditions:
- One entry per household
- Family friendly photos (no nudity please) (by submitting your photo you are agreeing to let us have all rights to the photo for publication on our site for advertising and community voting purposes)
- At least one person in the photo must be wearing our pin and playing a board game. (see “other conditions” for a no purchase required option.)
- No photo-shopping. We’ll be able to tell with our super high-tech laser eyes.
- All submissions will be judged (voted on) by the community.
- All submission due December 31, 2008.
- Voting will commence January 1, 2009 here on the blog!
- Voting closes January 31, 2009.
- Gift certificates for the winners will be sent via email on the evening of January 31, 2009.

- Nerd-iest Board Gamer (one winner – $50.00 Gift Certificate)
- Biggest Group (one winner - $50.00 Gift Certificate) Only one button for the entire group photo is required.
Winners Will Receive:
$50.00 Gift Certificate to Empire!
How To Do It:
1. Buy a board game from Empire
2. Wait patiently for your ultra-fast shipment
3. Gather your buddies (or yourself), and take a picture of you/your group while wearing the button.
4. Send your photo to support@empireboardgames.com with your name and category you’re applying to. Please note, your sending us your picture is giving us permission to put your photo (not name or any personal information) on our site and promotional material.

Other conditions:
No purchase necessary. Customers may also submit a picture with the words from the button “I Play Empire Board Games” on it to participate. Contest is restricted to the United States of America only.

Is it legal to have a contest like this that requires a purchase to enter?

Hey BigTuna,
We’re not requiring anybody to purchase anything from us. Everyone that purchases a game from us gets a cool Empire button. If one feels so inclined to take a picture of his group with the pin and submit it for a chance to win a certificate, then so be it. The use of the word “require” seems a bit off base to me.

Not that I would win the best looking, or the nerdiest, or the BIGGEST group. I just want the cool button!!

I think what he means is that ALOT of states and countries require that a contest be free and that no purchase be necessary. You are saying that to participate in the contest you need a button that is only available with a purchase hence this is not a free contest and therefore is not legal in all 50 states let alone some other countries.
I am not a lawyer but you may want to look up contest rules in all 50 states before you make it open to others. Also if you ship outside the US you need to either restrict this contest to the US or learn about other countries laws regarding contests. I think some countries require you to answer a question before you can win or something. The laws for contests very from place to place and what is legal in say Utah is not legal in Rhode Island.
I know your just trying to do a good thing but don’t get yourself in a legal bind because as we all know Ignorance of the law is not an excuse.

That’s cool. Sorry, didn’t mean to be a buzzkill or anything. I think it’s stupic that you have to jump through so many hoops just to give stuff away.
You know what would be really awesome? Sending out some buttons to some of your existing loyal customers who already bought a bunch of games but can’t buy any games right now due to the possibility of getting stuff on their want lists for christmas. Just an idea
